DCMA Policy and Content Takedown Policy for SellPass University
SellPass University respects the intellectual property rights of others and requires that our course creators do the same. This DMCA policy and content takedown policy sets out the procedures that SellPass University follows in response to notices of alleged copyright infringement by course creators using our platform.
DMCA Notices
If you believe that your copyrighted work has been infringed by a course creator using SellPass University, you may submit a written notice to us in accordance with the Digital Millennium Copyright Act (DMCA).
Your notice must include:
Identification of the copyrighted work that you claim has been infringed;
Identification of the material that you claim is infringing and its location on the SellPass University platform;
Your contact information, including your name, address, telephone number, and email address;
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Content Takedown
Upon receipt of a DMCA notice that complies with the requirements set forth above, we will promptly remove or disable access to the allegedly infringing material. We will also notify the course creator of the claim and provide them with an opportunity to respond.
If the course creator believes that the material was removed in error or that they have a valid fair use defense to the alleged infringement, they may submit a counter-notice to us. The counter-notice must include:
Identification of the material that was removed and its location on the SellPass University platform before it was removed;
Your contact information, including your name, address, telephone number, and email address;
A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside of the United States, for any judicial district in which SellPass University may be found; and
A statement that you will accept service of process from the person who provided the DMCA notice or their agent.

Repeat Infringers
SellPass University may terminate the account of any course creator who is a repeat infringer of copyright. We may also terminate the accounts of course creators who submit counter-notices that we determine are frivolous or have been submitted in bad faith.
